SUBDIVIDE YOUR PROPERTY

What is a Subdivision?

Subdivision is the process of dividing a single property into two or more separate parcels. This can be a great way to increase the value of your land, create new development opportunities, or simply make better use of your property.

The Subdivision Process

The subdivision process can vary depending on your local municipality, but it generally involves the following steps:

  1. Initial Consultation: Meet with a town planner to discuss your subdivision goals and assess the feasibility of your project.
  1. Application Submission: Prepare and submit a subdivision application to your municipality, including detailed plans and supporting documents.
  1. Review and Approval: The municipality will review your application and may request additional information or revisions. Once approved, you’ll receive permission to proceed.
  1. Surveying and Registration: A land surveyor will create new boundary lines for the subdivided parcels, which are then registered with the relevant authorities.

Professionals involved in the subdivision process:

  • Town Planner: The Town Planner drives the municipal approval process to ensure that all approvals are obtained. It is always advised to first consult with a Town Planner to ensure your subdivision proposal is feasible.
  • Land Surveyor: A Land Surveyor conducts a survey to ensure that the topographical data and existing structures are accurately captured for the subdivision diagram. They also compile a Surveyor General (SG) Diagram after the subdivision application is approved. Â
  • Architect:Depending on the Council requirements, an architect might be needed to compile a Site Plan or Site Development Plan for the proposed subdivision.
  • Civil Engineers: A Civil Engineer ensures that the proposed subdivision can connect to essential services within the area.  This is normally required after approval of the application.
  • Environmental Practitioners:An Environmental Practitionermight be required if there are any environmental sensitivities on the site. They ensure that the listing notices in terms of the National Environmental Management Act (NEMA) are upheld and may also submit a Landscape Development Plan if required by the Council.
  • Traffic Engineers:Depending on the number of land parcels being created, a traffic engineer may be required to submit a Traffic Impact Study and make suggestions on road upgrades. This is usually only applicable for subdivisions that generate a high number of daily trips.
  • Geotechnical Engineer:The Council might require a Geotechnical Report compiled by a professional geotechnical engineer, especially in areas with poor soil conditions or a risk of dolomite. Â
  • Attorney:Some municipalities require a conveyancing certificate compiled by an Attorney ÂThe attorney will also handle the transfer of the newly subdivided land parcels later in the process
  • Estate Agent:a Estate Agent can assist you selling your property once the subdivision has been registered.
